The Senior Resident Magistrate’s Court in Lilongwe has endorsed a plea bargaining agreement, convicting two companies on three counts each and imposing fines totaling K6.3 million.
Zamm Investments Limited was fined K4,500,000, while Zakariya Tutla received a fine of K1,800,000. The Court further ordered the forfeiture of 508 jerry cans (10,000 litres) of contaminated materials to the Malawi Bureau of Standards. All fines must be paid within 30 days of the endorsement, dated March 18, 2026.
Private practice lawyer Bruno Matumbi, acting as a public prosecutor under the authority of the Director of Public Prosecutions (DPP) Fostino Maele, wrote to the DPP on March 16, 2026, outlining the prosecution and defence’s agreement to resolve the matter through comprehensive plea bargaining. The DPP approved the arrangement.
Under the agreement, certain charges were withdrawn, while the proposed fines increased significantly, rising by 530 percent from K1 million to K6.3 million.
The case, Criminal Case No. 1487 of 2025, is now closed, with no further prosecutorial action required beyond compliance with the Court’s orders on payment of fines.
Endorsement of a plea agreement means the Court formally reviews and approves the settlement between prosecution and defence, ensuring it is fair, voluntary, and consistent with the law.
The Court must confirm that the defendants entered the agreement freely, without coercion, and with full understanding of its consequences. It also verifies that the arrangement does not compromise public interest, judicial integrity, or statutory requirements.
