The Chief Justice Rizine Mzikamanda yesterday in Blantyre dismissed an application by Counsel Paul Maulidi against the Attorney General (AG) for want of prosecution in Miscellaneous Cause Number 83 of 2010.
This is a disciplinary matter that involves allegations of misappropriation of funds by Maulidi.
The AG had applied for the striking off of Maulidi from the Roll of Legal Practitioners, citing allegations of misappropriation of money collected on behalf of his clients, in violation of the Legal Education and Legal Practitioners Act.
When the matter was called yesterday for hearing, the Respondent, Maulidi, was absent despite being aware of the court date, with no explanation provided for his non-attendance.
The AG, Thabo Chakaka-Nyirenda, requested the court to proceed with the hearing. The Chief Justice noted that the application for dismissal was supposed to be filed by the Respondent, who had sought to have the proceedings dismissed and stayed.
The Chief Justice ruled that Counsel Maulidi's application was dismissed with costs awarded to the AG for want of prosecution, with liberty to restore within seven days from yesterday.
The Chief Justice ordered that if the Respondent fails to comply, a date will be set for the AG to pursue the application to strike off Maulidi from the Roll of Legal Practitioners.
